(A) CRES shall be notified of an alleged defective part within fifteen (15) days after discovery of the defect. CRES reserves the right to request proof of purchase, as well as other proof to document a warranty claim. Failure to cooperate in that regard may cause the warranty to be voided.

(B) CRES does not warrant against, is not responsible for and no implied warranty shall be deemed to cover any condition attributable to:

• improper application and/or installation of CRES parts and/or failure to abide by CRES's installation/usage/application guidelines;
• use of CRES's parts beyond normal use or in application not recommended by CRES's guidelines and/or instructions;
• any Act of God (such as flooding, hurricane, earthquake, lightning, etc.), environmental condition (such as air pollution, mold, rust, etc.), introduction of foreign substances (such as dirt, grease, oil, etc.) or weathering (defined as exposure to sunlight, weather and atmosphere);
• improper handling, alterations, modifications, storage, installation, usage, lack of proper maintenance and/or service, abuse or neglect of CRES parts; or
• ordinary wear and tear.

(C) This warranty is not intended to supplant normal maintenance service and shall not be construed to mean that CRES provides free service for periodic adjustment or lubrication due to normal use. Lack of proper maintenance will void this limited warranty and CRES expressly denies any responsibility for ongoing maintenance and adjustment. CRES will not repair without charge, breakage, maladjustment or other defects arising from improper or inadequate maintenance, abuse, misuse or other causes beyond CRES'S control, including but not limited to improper installation, improper material supplied by others, improper repairs or modifications, abnormal environmental conditions, power supply deficiencies or acts of God. This warranty is non-transferrable except with the express written consent of CRES.

(D) This Limited Warranty is intended to apply to and is hereby strictly limited to only products which have been originally supplied or manufactured by CRES. CRES makes no representations nor accepts no duty, responsibility nor obligation with regard to any parts and/or products nor the warranties associated with parts and/or products which were not originally supplied and manufactured by CRES. This limited warranty does not extend to any parts and/or products nor the warranties associated with parts and/or products which were not originally supplied, designed or manufactured by CRES. Any and all manufacturer's warranties associated with parts and/or products which were not originally designed and manufactured by CRES shall be assigned and transferred to the original purchaser. No person or entity is authorized by CRES to make and CRES shall not be bound by any statement or representation as to quality or performance of its supplied/manufactured products other than as contained within this warranty. This warranty may not be altered or amended except in a written instrument signed by CRES and the original purchaser.

CRES's sole obligation under this limited warranty and the original purchaser's sole remedy under this Limited Warranty shall be limited to replacing or repairing at CRES's sole option, the parts or product, which have been deemed by CRES to be defective. Any defects attributable to the installation shall not be the responsibility of CRES and are specifically excluded from this limited warranty. CRES reserves the right to make changes in the design of its products including software. CRES shall not incur any obligation to install such changes or changes required by any other agency to products previously manufactured. Any other damages or claims are hereby deemed to have been expressly waived by the original purchaser.

CRES shall be responsible only for costs incurred by it in the direct repair or replacement of defective parts at its facility. All other costs, including but not limited to the removal and replacement, adjustments, freight or reinspection shall be the responsibility of the purchaser, installer or others. All warranty returns must be authorized in advance by CRES. CRES shall not be obligated to honor warranty claims unless all sums due CRES are paid in full. All parts sales are final, subject to the provisions of this warranty.

UNDER NO CIRCUMSTANCES WILL CRES BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER SUCH DAMAGES ARE SOUGHT IN CONTRACT, IN TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE AND STRICT LIABILITY) OR OTHERWISE, AND CRES' LIABILITY WITH RESPECT TO DEFECTIVE PRODUCTS SHALL IN NO EVENT EXCEED THE REPLACEMENT OR REPAIR COST OF SUCH PRODUCTS.

WARNING: THE INSTALLATION, ADJUSTMENT AND MAINTENANCE OF THIS PRODUCT OR ANY REPLACEMENT PARTS OR COMPONENTS IN THE PRODUCT SHOULD BE PERFORMED ONLY BY TRAINED TECHNICIANS WHO ARE FAMILIAR WITH THE OPERATION OF THE SYSTEM. IMPROPER INSTALLATION, ADJUSTMENT AND/OR MAINTENANCE CAN ENDANGER THE USER AND THE EQUIPMENT AND WILL VOID THIS WARRANTY.
